PROMOTIONAL GENERAL TERMS
1. These Promotional General Terms shall apply in conjunction with the Specific Terms of any promotion. You should therefore read these General Terms in combination with the Specific Terms. Where any Specific Terms conflict with these Promotional General Terms, the Specific Terms will take precedence.
2. We may change these Promotional General Terms at any time. You should check our website regularly for any changes that apply from the date they are uploaded.
3. By entering any promotion you agree that you will be legally bound by both these Promotional General Terms the Specific Terms and the General Terms.
4. All promotions are open to persons over 18 years of age at the time of entry. Where the Specific Terms state that a person aged 18 years or less is eligible to enter, we reserve the right to require that their parent or guardian confirms in writing that they agree to be bound by these terms and conditions and will accept any prize on behalf of the under-18 year old prizewinner.
5. It will be at the Promoters sole decision as to whether any eligibility requirement has or has not been met and we may require evidence or confirmation from entrants before awarding prizes.
6. Employees of the Promoter and their immediate families may not enter any promotion, neither may any employees or immediate family members of any third party sponsors, third party companies associated with the promotion, prize providers or agencies assisting with the promotion operation.
7. Deficient entries: the Promoter will not be responsible for any entries not received, not recognised, not accepted for any reason or delayed. Proof of sending or entering such details does not constitute receipt.
8. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of or unauthorised access to, or alteration of, or non-receipt of, entries. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Promoter or an entrant because of technical problems, operator problems, social media site problems, traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to any participant’s or any other third person’s, resulting from any participation or downloading any materials in the promotion.
9. Automated Entry: the use of any automated entry software or any other mechanical or electronic means that permits any person to enter any promotion repeatedly is prohibited. No bulk, consumer group or third party entries will be accepted. These entries will be disqualified.
10. Names: entrants must enter promotions using their full legal name. We reserve the right to disqualify any entrant who uses multiple names or any false names and to require them to return to the Promoter any prize they may have won.
11. Multiple Entries: Unless otherwise permitted by the Specific Terms, no person may enter any promotion more than once and persons may not enter or participate as part of a syndicate or on behalf of any other person, syndicate, group, society or company.
12. Retrospective Effect: where an entrant or prizewinner has not complied fully with the generic terms and specific promotion terms, or has been found to be in breach of any of the terms and conditions of a promotion and in particular where a person is in breach of the entry restrictions, the Promoter may nevertheless still enforce our right to disqualify that person and require the return or reimbursement to us of any prize even where a prize has already been awarded and/or actually provided to the entrant or prizewinner in question.
13. No fees shall be payable to any entrant in relation to their entry in any promotion. Obtaining time off work and/or study or related activities to participate in a promotion and/or use a prize. All related costs/time off will be at the sole and absolute responsibility of each entrant or person using the prize.
RFID CLOAKED FREE BLOCKING CARD OFFER SPECIFIC TERMS AND CONDITIONS:
1. The promotion, of a free Blocking card, is open to persons aged 18 and over, with the exception of the Promoter’s employees, their immediate families, agents or anyone else professionally connected with the promotion. The Promotion is for the sole purpose of raising and marketing RFID Cloaked’s intention to launch a Kickstarter campaign around a new product it is developing,
2. No purchase necessary but P&P payable is required to send the free Blocking card.
3. Only one free blocking card per person per household.

8. Entrants agree to participate in publicity accompanying or resulting from the promotion. No additional compensation will be awarded for such promotional activities.By submitting your details and clicking our TOS you agree to allow us to promote and market to you regarding our forthcoming Kickstarter campaign and inline with GDPR, your data will only be used by us for the purposes of promotional activities in relation to our forthcoming Kickstarter campaign, it may be shared (but will not be sold) only with GDPR approved 3rd parties You are free to opt out at any time
9. English law applies and the English courts shall have exclusive jurisdiction over any proceedings in connection with this promotion.
10. By participating in the promotion by requesting a free blocking card and agreeing to the P&P charge for the relevant country of the entrant, entrants will be deemed to be bound by and have accepted these terms and conditions.

2. Order process
2.1 All orders that you place on this website will be subject to acceptance in accordance with these terms and conditions.
2.2 The ‘confirmation’ stage sets out the final details of your order. Following this, we will send to you an order acknowledgement email detailing the products you have ordered. Please note that this email is not an order confirmation or order acceptance from RFID Cloaked.
2.3 Acceptance of your order and the completion of the contract between you and us will take place on despatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it (please refer to Returns and refunds).

3.1 This website is only for delivery of products to customers worldwide. All goods must be signed for by an adult aged 18 years or over on delivery.
3.2 Delivery charges and estimated timescales are specified in the checkout and also when you place an order. We make every effort to deliver goods within the estimated timescales, however delays are occasionally inevitable due to unforeseen factors. RFID Cloaked shall be under no liability for any delay or failure to deliver the products within estimated timescales.
3.3 Risk of loss and damage of products passes to you on the date when the products are delivered to you or are left with a person or place nominated by you.
4.1 We take payment from your card or PayPal account at the time we receive your order, once we have checked your card or PayPal details and stock availability. Goods are subject to availability. In the event that we are unable to supply the goods, we will inform you of this as soon as possible. A full refund will be given where you have already paid for the goods. 4.2 To ensure that your credit, debit, charge card or PayPal account is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998 and in line with GDPR, We will not sell your data. We may share your data with 3rd parties but only GDPR approved 3rd parties.
4.3 a) Online price errors. If we discover an error in the price of goods ordered or reserved, we will inform you as soon as possible (e.g. prior to the goods being despatched or in store prior to the collection of the goods). We will provide you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you choose to cancel and have already paid for the goods you will receive a full refund.
b) If you reserve a product and the price changes (due to normal fluctuations e.g. goods going into or coming out of promotion) before you collect the item, you may request to pay the lowest of i) the price on reservation or ii) the prevailing price in store at the time of collection. This will also apply if your reservation is extended but not if the reservation collection window has expired.

4.4 Payment can be made by any method specified in checkout.
4.5 Title to any products you order on this website shall pass to you on delivery of the products provided that we have processed and received payment in full for the products.

5. Returns, Cancellations and Substitutions
5.1 We offer a 30-day money back guarantee, please refer to Returns and refunds. Some products are excluded from the Guarantee and are clearly marked by a † next to the product name. In the unlikely event that you receive faulty or damaged goods, please refer to our Returns and refunds section.
5.2 Sometimes the product specifications from the manufacturer may change, in which case we will do our best to offer you a similar alternative. We may experience problems with the supply of certain products and may therefore supply a substitute of the same or better quality at the same price. 7.3 Subject to Section 7.1 above, other than as expressly provided in these terms and conditions with respect to specific products and except for the exclusive remedies set out at Section 5 above, any indemnities, warranties, terms and conditions (whether express or implied) are hereby excluded to the fullest extent permitted under applicable law.
7.4 Subject to Section 7.1 above, RFID Cloaked will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent on negligent misrepresentations) or otherwise out of or in connection with the terms and conditions for any:
- economic losses (including without limitation loss of revenues, data, profits, contracts, business or anticipated savings); or
- loss of goodwill or reputation; or
- special or indirect losses
- suffered or incurred by that party arising out of or in connection with the provisions of any matter under these terms and conditions.
7.5 Notwithstanding the above, subject to Section 7.1 RFID Cloaked’ aggregate liability (whether in contract, tort or otherwise) for loss or damage shall in any event be limited to a sum equal to the amount paid or payable by you for the product(s) in respect of one incident or series of incidents attributable to the same clause.
7.6 This clause 7 does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights.
7.7 We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.
8. Miscellaneous Provisions
8.1 The contract between us shall be governed by the laws of England and any dispute between us will be resolved exclusively in the courts of England. English is the only language offered for the conclusion of the contract.

8.9 No delay or failure by RFID Cloaked to exercise any powers, rights or remedies under these terms and conditions will operate as a waiver of them nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver to be effective must be in writing and signed by an authorised representative of RFID Cloaked.
8.10 These terms and conditions including the documents or other sources referred to in these terms and conditions supersede all prior representations understandings and agreements between you and RFID Cloaked relating to the use of this website (including the order of products) and sets forth the entire agreement and understanding between you and RFID Cloaked for your use of this website.
